Liability
As a provider for special deliveries and express transport, we operate generally and exclusively in accordance with the ADSp (German Freight Forwarders' Standard Terms and Conditions) and the CMR (Convention on the Contract for the International Carriage of Goods by Road).
Therefore our services are subject to the ADSp and the CMR, in the current respective versions thereof. This means that the following liability limits apply:
Liability limits
Damage to goods (excluding sea) 40.00 SDR*/gross weight (kg)
Damaged caused by delay: three times the carriage charges
Example case
Gearbox with a gross weight of 200 kg to be transported within Germany at a price of € 250.00 net. Value of goods: € 3,000.00.
Goods are damaged
Damage to goods: Liability in accordance with ADSp, i.e. 40 SDR/gross weight (kg) = 40 SDR x 1.1 x 200 kg
Results in maximum liability of € 8,800.00
Total value of goods, i.e. € 3,000.00, paid as compensation.
Transport is delayed
Damage caused by delay: Liability in accordance with German Commercial Code/German Freight Forwarders' Standard Terms and Conditions, i.e. three times the carriage charges = 3 x € 250.00
Results in maximum liability of € 750.00.

Maximum limit CANNOT be contractually increased!
Damaged caused by delay: basic carriage charges
Example case
Gearbox with a gross weight of 200 kg to be transported from Germany to Italy at a price of € 250.00 net. Value of goods: € 3,000.00.
Goods are damaged
Damage to goods: Liability in accordance with CMR, i.e. 8.33 SDR/gross weight (kg) = 8.33 SDR x 1.1 x 200 kg, corresponds to maximum liability of € 1,832.80.
Transport is delayed
Damage caused by delay: Liability in accordance with CMR, i.e. basic carriage charges =1 x € 250.00.
Results in maximum liability of € 250,00.
